CITY OF POOLER
COUNCIL MINUTES
September 16, 2013    

The regular meeting of the Pooler City Council was held on September 16, 2013.

Mayor Lamb called the meeting to order at 6:00 p.m. Present were Councilman Bruce Allen, Councilwoman Rebecca Benton, Councilwoman Shannon Black and Councilman Stevie Wall. City Manager Robbie Byrd and Finance Officer/Assistant City Manager Michelle McNeely were present. Attorney Craig Call was present on behalf of City Attorney Steve Scheer. Councilman David Burke was absent due to work

The invocation was given by Councilman Allen and the Pledge of Allegiance was led by Councilwoman Black.

The minutes of the previous meeting were approved as printed upon a motion by Councilwoman Benton, seconded by Councilman Wall, with no opposition.

The minutes of the September 3rdExecutive Session were approved upon a motion by Councilman Wall, seconded by Councilwoman Benton, and passed without opposition.

Report from the Standing Committees: 

FINANCE

Councilman Wall presented bills in excess of $1500.00 for the month and made a motion to pay the bills, subject to funds. Motion was seconded by Councilman Allen and passed without opposition. 

PUBLIC SAFETY

Councilman Wall stated that the fire department responded to 114 calls this month, totaling 1806 for the year and that the police department responded to 1138 calls, totaling 22,331 for the year. 

STREET/DRAINAGE

Councilwoman Benton reported that the street and drainage departments performed routine maintenance.

WATER/SEWER

Councilman Wall reported that the water and sewer departments performed routine maintenance and that all parameters are being met at the wastewater treatment plant. 

RECREATION

Councilwoman Black reported that dance and tumbling classes continue, as well as football, fall soccer, men’s basketball and co-ed softball.

 BUILDING/ZONING

Councilman Allen reported that seven (7) new single family residential and one (1) commercial permit were issued since the last meeting, totaling 131 single family and 91 commercial permits for the year, with 3815 inspections performed.

There was no OLD BUSINESS to discuss.

Councilman Mike Royal arrived at the meeting.

Under NEW BUSINESS the following was discussed:

1.Requested20' sign height variance to place a monument sign at the intersection of Park Avenue & Pooler Parkway

Councilwoman Benton stepped down from her seat. A public hearing was held prior. Mr. Byrd stated that Planning & Zoning has recommended denial, based on the request not meeting two of the three criteria for granting a variance. Terry Coleman of Coleman Company, Inc. stated that the variance is for height only and is proposed within the sign easement granted by the owner, South Godley Enterprises, to advertise the Outlet Mall and two (2) apartment complexes on Park Avenue. Councilman Allen made a motion to deny the variance. Motion was seconded by Councilman Wall and passed with Councilman Royal opposing.

Councilwoman Benton returned to her seat. 

2. Recombination plat of Lots 10 and 11 at intersection of Old Dean Forest Road & Highway 80

Mr. Byrd stated that the petitioner has requested this item be tabled. Councilman Allen made a motion, seconded by Councilwoman Benton, to table. Motion passed without opposition.

3. Site plan for new Gerdau Steel office building at 1755 Dean Forest Road        

Mr. Byrd stated that the petitioner has requested this item be tabled. Councilman Allen made a motion to table. Motion was seconded by Councilwoman Benton and passed without opposition.

4. Revised preliminary construction plan for The Fairways, Phase 12, to add phase line

The developer of The Fairways at Savannah Quarters has submitted a revised preliminary construction plan for Phase 12 to break it into two (2) sections, thus adding a phase line. Councilman Allen made a motion, seconded by Councilwoman Benton, to approve the plan. Motion passed without opposition

5. Special event permit for Pooler Outdoor Music Concert to be held October 5th,                      sponsored by Pooler Chamber of Commerce & Visitors Bureau, and to waive                  fees                                   

Karen Robertson, Executive Director of the Pooler Chamber of Commerce & Visitors Bureau, presented a request to allow the Pooler Outdoor Music Concert to be held October 5that Oglethorpe Speedway Park. Councilman Allen made a motion to approve the event and to waive the fees. Motion was seconded by Councilwoman Benton and passed without opposition.

6. First Reading on amendment to sign ordinance regarding temporary special events

Mr. Byrd requested this item be tabled for further review and comments from the city attorney. Councilman Allen made a motion, seconded by Councilwoman Benton, to table. Motion passed without opposition.

Councilman Wall made a motion to add Item #7 to the agenda. Motion was seconded by Councilwoman Benton and passed without opposition.

7. Authorization for mayor to sign Georgia Environmental Finance Authority (GEFA)   loan application

Ms. McNeely presented a loan application for $6,253,940.00 for several water and sewer projects. Councilman Wall stated that these are very important projects needed to maintain the city’s utilities due to the amount of growth being experienced and made a motion to authorize Mayor Lamb to sign the application. Motion was seconded by Councilman Allen and passed without opposition.

Councilwoman Black made a motion to add Item #8 to the agenda. Motion was seconded by Councilman Allen and passed without opposition.

8. Award bid for gymnasium addition/repairs

Mr. Byrd presented bids for the installation of a pre-engineered metal building to be added to the gymnasium and repairs to the existing roof, and bids for two (2) concrete pads. Councilman Allen made a motion to award the bid for the addition/repairs to the low bidder, Southern Steel Erectors, LLC in the amount of $135,146.75 and to award the bid for the concrete pads to the low bidder, Woods Contracting, Inc., in the amount of $24,339.00. Motion was seconded by Councilman Royal and passed without opposition.

Councilman Allen made a motion to adjourn to Executive Session to discuss legal, land acquisition and personnel matters at approximately 6:44 p.m. Motion was seconded by Councilwoman Benton and passed without opposition.

Mayor Lamb called the meeting back to order at 7:00 p.m. 

Councilman Allen made a motion to adjourn at approximately 7:00 p.m. Motion was seconded by Councilman Royal and passed without opposition.

                                                               Public Hearing 

A public hearing was held prior to the regular City Council meeting on September 16, 2013. Mayor Mike Lamb called the hearing to order at 5:45 p.m. Present were Councilman Bruce Allen, Councilwoman Shannon Black and Councilman Stevie Wall. City Manager Robbie Byrd and Finance Officer/Assistant City Manager Michelle McNeely were also present. Attorney Craig Call was present on behalf of City Attorney Steve Scheer.

The purpose of the hearing was to discuss a requested 20' sign height variance to place a monument sign at the intersection of Park Avenue & Pooler Parkway. Terry Coleman of Coleman Company, Inc. presented a request to allow a 50' monument sign for the proposed Outlet Mall of Georgia to be placed within a sign easement granted by the property owner, South Godley Enterprises. Mr. Coleman stated that the variance is strictly for height and that it is proposed to advertise the proposed outlet mall and the two (2) apartment complexes on Park Avenue. Further, that the proposed height is needed for visibility. Robert Gore, Operations Manager for Georgia Heritage Federal Credit Union, presented concern that the proposed sign will block the Credit Union’s sign, stating that when the Credit Union opened a few years ago, their request for a 50' sign was denied. Mr. Coleman stated that placement of the sign will be considered so it will not obstruct visibility of the Credit Union’s sign.

There being no further discussion, the hearing was adjourned at approximately 5:53 p.m.
