CITY COUNCIL MINUTES
December 6, 2010


The regular meeting of the Pooler City Council was held on December 6, 2010. Mayor Mike Lamb called the meeting to order at 6:00 p.m. Present were Councilman Bruce Allen, Councilwoman Rebecca Benton, Councilwoman Shannon Black, Councilman David Burke, Councilman Mike Royal and Councilman Stevie Wall. City Manager Robbie Byrd and City Attorney Steve Scheer were also present.

The invocation was given by Councilman Allen and the Pledge of Allegiance was led by Councilman Burke.

The minutes of the previous meeting were approved as printed upon a motion by Councilman Allen, seconded by Councilwoman Benton, with no opposition.

Report from the Standing Committees:

FINANCE

Councilman Burke presented accounts payable information for November, making a motion to pay bills in excess of $1500.00, subject to funds. Motion was seconded by Councilman Wall and passed without opposition.

PUBLIC SAFETY

Councilman Royal reported that the police department responded to 1411 calls from November 12ththrough December 2ndand that the fire department responded to 206 calls in November. Councilman Royal presented the new Police Chief, Mark Revenew. Mr. Scheer then administered the oath of police chief to Chief Revenew.

Deputy Fire Chief Ashley Fields presented award recipients recently nominated by the Pooler Firefighters’ Association as follows: Rookie Firefighter of the Year, Charlie Rogers, Firefighter of the Year, James Self, Officer of the Year, Mario Rodriguez.

PARKS & TREES/STREET/DRAINAGE

Councilwoman Benton reported that the parks and trees, street and drainage departments performed routine maintenance and commended the parks and trees department for their hard work in preparing for the Christmas Tree Lighting held Sunday night.

WATER/SEWER

Councilman Wall reported that the water and sewer departments have performed routine maintenance and that all parameters have been met at the wastewater treatment plant.

RECREATION

Councilwoman Black reported that fall tumbling and dance classes continue.


BUILDING/ZONING

Councilman Allen reported that seven (7) single family residential, two (2) residential attached unit and one (1) commercial permit has been issued since the last meeting, totaling 126 single family, 20 attached unit and 41 commercial permits for the year, with 3064 inspections performed.

Mayor Lamb presented a 10-year service pin to Police Sergeant Karen Zantow, thanking her for her continued service.

Robert Bennett of Mitsubishi Power Systems presented a check as a donation to the fire department.

Mayor Lamb stated that Karen Robertson, Executive Director of the Pooler Chamber of Commerce and Visitors Bureau, would make her presentation at the next meeting.

There was no OLD BUSINESS to discuss.

Under NEW BUSINESS the following was discussed:

1. Approval of site plan for a proposed tractor trailer storage yard at 130 Pine Meadow Drive

Jay Maupin, on behalf of property owner, Franklin McKinney, presented a request for an expansion of the existing tractor/trailer yard at 130 Pine Meadow Drive. Mr. Byrd stated that all of the engineering comments have been addressed and that Planning & Zoning has recommended approval. Councilman Wall questioned whether the trailers would be stacked wherein Mr. Maupin replied that this yard was for temporary storage only and trailers would not be stacked. Councilman Allen made a motion to approve the site plan, contingent upon asphalt millings being used for the surface instead of solid asphalt pavement as noted in the city engineer’s letter. Motion was seconded by Councilwoman Benton and passed without opposition.

2. Approval of final PUD/preliminary construction plan for The Gates at Savannah Quarters, Phase 2

Mr. Byrd presented a final PUD and preliminary construction plan consisting of 74 single-family residential lots known as The Gates at Savannah Quarters, Phase 2, stating that Planning & Zoning and staff have recommended approval. Dennis Smith of Thomas & Hutton Engineering was present and stated that the lots in the development have remained within the percentage of total lots having 60' widths. Councilman Allen made a motion to approve the final PUD and preliminary construction plan. Motion was seconded by Councilwoman Benton and passed without opposition.


3. Release of performance bond/acceptance of maintenance bond/approval of water and sewer easement plat through Pooler Marketplace Subdivision

Mr. Byrd presented a request from the developer of Pooler Marketplace Subdivision, stating that construction is complete and a final inspection was performed on October 12th, with all punch list items being addressed. Further, that a maintenance bond in the amount of $134,053.00 has been posted for the paving and drainage work and for the on-site water and sewer mains, which will be owned and maintained by the City. Councilman Allen made a motion, seconded by Councilman Burke, to release the performance bond and accept the maintenance bond, contingent upon Mr. Scheer approving the bond. Motion passed without opposition.

4. Release of maintenance bond for The Gates @ Savannah Quarters, Phase 1B

Mr. Byrd presented a request from the developer of The Gates @ Savannah Quarters, Phase 1B, stating that a final inspection was performed and the public works department has recommended release of the maintenance bond. Councilman Wall made a motion to release the maintenance bond. Motion was seconded by Councilman Allen and passed without opposition.

5. Release of performance bond for Cap Barbell at 155 Distribution Drive

Mr. Byrd stated that a final inspection was performed on the grassing and stabilization and that the public works department has recommended release of the performance bond. Councilman Wall made a motion, seconded by Councilman Allen, to release the performance bond for Cap Barbell. Motion passed without opposition.

6. Approval of amended 2010 budget (restricted) for the Pooler Chamber of Commerce and Visitors Bureau

Mr. Byrd stated that Mr. Scheer has not had time to review the information and therefore, Councilman Allen made a motion to table this item. Motion was seconded by Councilwoman Benton and passed without opposition.

7. Approval of Agreement for Promotion of Tourism for 2011 with the Pooler Chamber of Commerce and Visitors Bureau

Mr. Byrd stated that Mr. Scheer has not had time to review the Agreement, therefore, Councilman Allen made a motion, seconded by Councilwoman Benton, to table this item. Motion passed without opposition.

8. Approval of Amendment to GMEBS OPEB Trust Participation Agreement

Mr. Byrd presented the Amendment to GMEBS OPEB Trust Participation Agreement, stating that it must be updated annually. Councilman Allen made a motion to approve the Amendment. Motion was seconded by Councilman Burke and passed without opposition.

9. First Reading on proposed 2011 budget

A public hearing was held prior. Mr. Byrd presented the proposed 2011 budget, stating that the General Fund balances at $12,722,167.00, the Water and Sewer Fund balances at $5,651,206.00 and the Hotel/Motel Tax Fund balances at $560,000.00. Councilman Wall stated that the proposed budget includes a 10% increase in water and sewer (variable) fees, a one-and-a half percent (1.5%) longevity increase for all eligible employees and $1.5 million in capital outlay for the construction of three (3) fire stations. After discussion, Councilman Wall made a motion to approve the 2011 budget on First Reading. Motion was seconded by Councilman Allen and passed without opposition.

10. First Reading on amendment to Water Conservation ordinance regarding restrictions on outdoor watering of landscape

Mr. Byrd presented an amendment to the Water Conservation ordinance, as mandated by the State of Georgia, regarding restrictions on outdoor watering of landscape, noting that watering may only occur between the hours of 4:00 p.m. and 10:00 a.m., providing a list of outdoor water uses that the limitation will not affect. Councilman Allen made a motion, seconded by Councilman Burke, to approve the amendment on First Reading. Motion passed without opposition.

There being no further business to discuss, Councilman Allen made a motion to adjourn at approximately 6:44 p.m. Motion was seconded by Councilman Wall and passed without opposition.

                                                               Public Hearing

A public hearing was held prior to the regular City Council meeting on

December 6, 2010. Mayor Lamb called the hearing to order at 5:45 p.m. Present were Present were Councilman Bruce Allen, Councilwoman Rebecca Benton, Councilwoman Shannon Black, Councilman David Burke, Councilman Mike Royal and Councilman Stevie Wall. City Manager Robbie Byrd and City Attorney Steve Scheer were also present.

The purpose of the hearing was to discuss the proposed 2011 budget. Mr. Byrd presented the budget, stating that the General Fund balances at $12,722,167.00, the Water & Sewer Fund balances at $5,651,206.00 and the Hotel/Motel Tax Fund balances at $560,000.00.

There being no further discussion, the hearing was adjourned at approximately 5:48 p.m.
